General conditions of participation of the dance school DiaoDance - Kizomba dancing in Hamburg (as of 08/01/2020)

Scope

The following information applies to all events organized by DiaoDance.

Registration
To participate in our programs, prior written registration is required. Please use the registration form on the website. Upon submitting the online registration and receiving the registration confirmation, a legally binding contract is created. This contract is also valid if no payment has been made. For minors, registration must be completed by a parent or legal guardian. DiaoDance will send a registration confirmation within 7 days of receipt of the registration, including further information for transferring the participation fee.

The booked course or workshop cannot be transferred to anyone other than the registered person.

Right of withdrawal
When registering via the Internet using the online registration form, the customer has no statutory right of withdrawal. Dance courses and workshops are services in the field of recreational activities. These are excluded from the right of cancellation in accordance with Section 312g (3) No. 9 BGB.

Dance partner regulation
It is preferable for couples to register. Individual registrations are also accepted, but there can be no fixed dance partner guarantee. The participant is responsible for ensuring that he has a dance partner during the course dates. The dance school does not guarantee this. The absence of a dance partner does not constitute an extraordinary right of termination. If too many (individual) registrations have been received, the dance school is entitled to reject them or to put them on a waiting list if the customer wishes to participate at a later date. 

Payment due date
Registration obliges the customer to pay the full fees. The contributions are due immediately after registration, unless otherwise agreed. These are to be paid by bank transfer. The fee is due even if the customer does not attend the course. The payment must be made up immediately.

Late payment
If the customer / participant is in arrears with his payments, we are entitled to charge additional reminder fees of € 3.00 after the payment reminder has been issued.

Running time
A course runs for one calendar month (courses always begin on the 1st of the month).

Each course/workshop includes a fixed number of lessons at predetermined dates. There are no contract terms and no cancellation periods. Time cards, also called Flex Cards, have a fixed number of dance units. These units can be completed within a specified period of validity in ongoing courses starting at the intermediate level (no workshops/crash courses). Time cards are valid for a limited period. This period begins on the day of issue and ends, depending on the respective offer, 2/3/4/6 months after issue. The time card is transferable and can be used by other people at the same time. If you forget your time card, you will not be able to dance.

Lost hours, missed hours

A reimbursement of course fees for lessons missed by the participant (e.g. due to illness, vacation, business trip) cannot be made. A reimbursement of unused units of season tickets (e.g. due to illness, vacation, business trip) cannot be made. Missed course hours due to illness or the prevention of the course leader will be made up for.

Private lessons
Private lessons must be canceled at least 24 hours in advance. No-shows will be billed as the hour used.

Changes in the range of courses

For compelling reasons (e.g. insufficient number of participants) events can be postponed or merged or the times can be changed. If the minimum number of participants required for a course or workshop is not reached, we reserve the right to cancel the respective course at least 24 hours before the start of the course. Any course fees already paid will be refunded immediately. We will not reimburse any travel or accommodation costs incurred in connection with the canceled workshop.

Gift certificates
Vouchers are valid for 6 months after they have been issued. The stated prices apply. A cash payment is not possible. There will be no reimbursement for vouchers that have not been used after the period of validity has expired.

Video and photo recordings
Photos and video recordings will be made during the courses / workshop. DiaoDance reserves the right to use them for advertising purposes on the Internet. By registering, the participant hereby declares their consent and the exploitation of the film and photo rights pass into our possession free of charge. In order to protect personal rights, however, the participant has the option of withdrawing this permission before the course / workshop. The course management must be informed of this immediately. Photos and video recordings by participants are only permitted with prior consent and may only be used for private purposes.

Privacy
The participants agree to the storage of their personal data until further notice. The revocation is possible at any time. The login data is only used internally. It will not be passed on to third parties. In principle, no telephone numbers, emails or other data of the participants are given to other participants.

Liability
The practice of dance is at your own risk. DiaoDance assumes no liability for personal injury or damage to property not caused by the course leader.
DiaoDance assumes no liability for damage to or loss of items of any kind, including the straight rack. The information on course dates, course locations, dates or fees made on the Internet or other advertising is provided without guarantee.

Come into effect
With the registration in electronic form via the registration form or by e-mail, at the latest when entering the classrooms and participating in the DiaoDance events, this information is expressly acknowledged and accepted as binding.
